What Is Bankruptcy?

Bankruptcy is a legal proceeding for people who are unable to pay their debts can get rid of the debts and get a new financial start. These proceedings are handled by the United States Bankruptcy Courts, including the U.S. Bankruptcy Court for the District of Hawaii.

Tax debts, student loans, back child support, back alimony, and fines or tickets issued by a court cannot be discharged by a Chapter 7 bankruptcy. Credit card debts, unsecured bank loans, monies owing from the repossession of a vehicle, medical bills, and lawsuit judgments are debts that can be discharged.

Chapter 13 of the U.S. Bankruptcy code, the reorganization involves creating a repayment plan toward the individual’s debts, taking place over a time, up to 5 years. The repayment plan is based upon calculating the individual’s income over and above their normal monthly expenses. The creditors all receive a portion of the monthly payment during the life of the repayment plan. At the completion of the repayment plan time period, the remaining unsecured debts are discharged.
